These Terms of Service ("Terms") govern your use of the BlockNegativism browser extension and website at https://blocknegativism.top (collectively, the "Service"). By installing the browser extension or using our website, you agree to these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Description of Service

BlockNegativism is a browser extension that automatically detects and filters negative content as you browse the web. Using advanced machine learning, the extension analyzes text in real-time locally on your device to help you avoid toxic comments, negative news, and other content that can affect your mental well-being and productivity.

Key features include:
- Real-time sentiment analysis and content filtering
- Customizable filtering profiles (Mild, Moderate, Strict, and custom)
- Local processing - all analysis happens on your device
- Cross-browser support (Chrome, Firefox, Safari)
- Multiple action types: Hide, Replace, or Annotate negative content
- Site whitelisting and blacklisting

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

For users under 18, parental or guardian consent is required before using the Service.

3. Account Registration and Security

3.1 Free Tier
The Free tier does not require account registration. You can install and use the extension immediately without providing any personal information.

3.2 Pro and Enterprise Tiers
Pro and Enterprise tiers require account registration. When creating an account, you must:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account

You are responsible for all activities conducted through your account.

4. Subscription Plans and Pricing

4.1 Free Plan
The Free plan includes:
- Basic sentiment filtering
- 3 standard profiles (Mild, Moderate, Strict)
- Manual on/off toggle
- Use on 1 device
- No time limit

4.2 Pro Plan ($4.99/month)
The Pro plan includes:
- All Free features
- Unlimited custom profiles
- Profile scheduling (auto-switch by time/day)
- Advanced filtering options
- Export browsing statistics
- Priority email support
- Early access to beta features
- Use on up to 5 devices
- 14-day free trial for new users

4.3 Enterprise Plan (Custom Pricing)
The Enterprise plan includes:
- All Pro features
- Admin console for team management
- SAML/SSO authentication
- Bulk license management
- Custom content integrations
- Dedicated account manager
- SLA guarantee
- Priority development requests
- Unlimited devices

4.4 Pricing Changes
We reserve the right to modify subscription pricing. Current subscribers will be notified at least 30 days before any price changes take effect. Price changes will not affect your current billing cycle.

5. Payment Terms

5.1 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. We do not store your credit card information.

5.2 Billing
- Pro subscriptions are billed monthly on a recurring basis
- You authorize us to charge your payment method on each billing cycle
- If a payment fails, we will attempt to process it again. Continued payment failures may result in suspension of your account
- You are responsible for any fees or charges incurred with your payment provider

5.3 Free Trial
New Pro users receive a 14-day free trial. You may cancel anytime during the trial without being charged. If you don't cancel before the trial ends, you will be automatically charged for the Pro plan.

5.4 Cancellation
You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of the billing period.

5.5 Refund Policy
- Free Plan: No refunds applicable (free service)
- Pro Plan: Full refund available within 14 days of your first payment (not including free trial period). After 14 days, no refunds for partial months.
- Enterprise Plan: Refund terms specified in your Enterprise agreement
- Refunds are processed within 5-10 business days

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

6.1 Prohibited Activities
- Use the Service to violate any applicable laws or regulations
- Attempt to reverse engineer, decompile, or disassemble the Service
- Remove, modify, or tamper with any copyright, trademark, or proprietary notices
- Use the Service to create a competing product or service
- Attempt to circumvent device limits or subscription restrictions
- Share your account credentials with others (except for Enterprise team management)
- Use the Service to harm, harass, or violate the rights of others
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) to access the Service
- Resell or redistribute the Service without authorization

6.2 Content Filtering Misuse
- Attempt to use the Service to bypass content moderation systems on other platforms
- Use the Service to facilitate illegal activities or access illegal content
- Misrepresent the capabilities or functionality of the Service

Violation of these terms may result in immediate termination of your account without refund.

7. Device Limits

- Free Plan: 1 device
- Pro Plan: Up to 5 devices
- Enterprise Plan: Unlimited devices (or as specified in your agreement)

A "device" is defined as a unique browser installation where the extension is active. Uninstalling the extension from a device frees up that device slot.

8. Intellectual Property Rights

8.1 Our Intellectual Property
The Service, including the browser extension, website, machine learning models, algorithms, user interface, design, and all associated intellectual property rights, are and will remain the exclusive property of BlockNegativism.

These Terms do not grant you any rights to:
- Use our trademarks, logos, or brand elements
- Copy or reproduce the Service
- Create derivative works based on the Service

8.2 Open Source Components
The browser extension includes open-source code available under various licenses. The open-source components are subject to their respective licenses, which are available in our GitHub repository.

8.3 User Data
You retain all rights to any content you create or settings you configure while using the Service. We do not claim ownership of your data.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, available at https://blocknegativism.top/privacy-policy.

Key privacy commitments:
- All content filtering happens locally on your device
- We never see or store your browsing data
- We do not track the websites you visit or content you view
- Free tier users are not required to create an account

10. Service Availability and Modifications

10.1 Service Availability
We strive to provide reliable service, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:
- Scheduled maintenance
- Technical issues
- Browser or platform updates
- Circumstances beyond our reasonable control

10.2 Service Modifications
We reserve the right to:
- Modify, update, or discontinue features of the Service
- Release new versions of the browser extension
- Change system requirements

We will provide reasonable notice for significant changes that materially affect functionality.

10.3 Browser Compatibility
The Service is designed for Chrome, Firefox, and Safari browsers. We are not responsible for compatibility issues arising from:
- Unsupported browsers or browser versions
- Conflicts with other browser extensions
- Browser updates that affect functionality

11. Machine Learning Accuracy

The Service uses machine learning models to analyze content sentiment. While we strive for high accuracy:

- Filtering is not 100% accurate and may produce false positives or false negatives
- Accuracy may vary across different languages, contexts, and content types
- We do not guarantee that all negative content will be filtered
- We do not guarantee that no positive content will be incorrectly filtered

You acknowledge that content filtering is based on automated analysis and may not align perfectly with your personal judgment in all cases.

12. Third-Party Services and Websites

The Service may contain links to third-party websites or integrate with third-party services (e.g., browser extension stores). We are not responsible for:
- The content, privacy practices, or terms of third-party services
- Any damages or losses resulting from your use of third-party services

Your use of third-party services is at your own risk and subject to their terms.

13. Disclaimers and Limitations of Liability

13.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- Content filtering will be accurate in all cases
- Defects will be corrected

13.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOCKNEGATIVISM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of the Service
- Any bugs, viruses, or other harmful code transmitted through the Service
- Any errors or omissions in content or for any loss or damage incurred from use of any content
- The accuracy or reliability of content filtering

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless BlockNegativism, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations

15. Term and Termination

15.1 Term
These Terms remain in effect while you use the Service.

15.2 Termination by You
You may terminate at any time by:
- Canceling your subscription (Pro/Enterprise)
- Uninstalling the browser extension
- Deleting your account (if applicable)

15.3 Termination by Us
We may suspend or terminate your account and access to the Service:
- For violation of these Terms
- For fraudulent activity or payment issues
- If required by law
- If we discontinue the Service

We will provide reasonable notice before termination unless immediate termination is necessary for legal or security reasons.

15.4 Effect of Termination
Upon termination:
- Your right to use the Service immediately ceases
- We will delete your account data according to our Privacy Policy
- You remain responsible for any fees incurred before termination
- Sections of these Terms that by their nature should survive termination will survive (e.g., intellectual property, disclaimers, limitation of liability)

16. Dispute Resolution and Governing Law

16.1 Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

16.2 Informal Resolution
Before filing a legal claim, you agree to contact us at bartzalewskidev@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

16.3 Jurisdiction
Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in France, and you consent to personal jurisdiction in such courts.

We may update these Terms from time to time. Changes may be necessary due to:

- Service updates or new features

When we make changes:

- Your continued use of the Service after changes take effect constitutes acceptance of the new Terms

18. General Provisions

18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BlockNegativism regarding the Service.

18.2 Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

18.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

18.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms without restriction.

18.5 No Agency
No agency, partnership, joint venture, or employment relationship is created between you and BlockNegativism as a result of these Terms or your use of the Service.

18.6 Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

18.7 Language
These Terms are written in English. Any translated versions are provided for convenience only. In the event of any conflict between the English version and a translated version, the English version shall prevail.

- You are at least 13 years old (or have parental consent if under 18)
